Joshua Jackson and Jodie Turner-Smith Cancel Trial Amid Custody Negotiations

While the two had initially agreed to maintain “the existing temporary joint legal and physical custody orders, awarding joint legal and physical custody to the parties with equal timeshares” in their May divorce settlement, the legal battle continued when Joshua filed a motion on May 30 requesting an emergency custody order modification. He alleged at the time that Jodie had enrolled Juno in a new school without his permission and outside of the agreed-upon 45-minute commute from his house.

"Respondent respectfully requests orders ensuring that the minor child continues attending her present school for the next academic year 2025-2026,” the documents obtained by E! News read, “and for the parents' joint consent to be required for any subsequent school change."

The Doctor Odyssey star also claimed that he was concerned the Queen & Slim actress was “attempting to create a scenario where Juno travels with her rather than attending a traditional school,” noting Jodie often films in London during the year and had sent Joshua a text that their daughter could use tutors and remote learning. 

Included in his motion were letters from both Joshua and Jodie, defending their allotted time with Juno.

“I'm also glad we agree that our shared goal is to provide Juno with as much stability, consistency, and meaningful time with both of us as possible,” Jodie, 38, wrote in a letter sent to Joshua on May 23. “I hear and appreciate your point that this is ultimately her time with each of us, and not the other way around. That framing feels important.”

The Acolyte actress—who initially filed for divorce from Joshua in Oct. 2023—also requested that Juno spend five weeks with her in Europe over the summer. However, Joshua expressed his concern in a May 26 response, writing that the arrangement would have him going four-weeks without seeing Juno. 

“I think that maximizing that frequent, continuing and meaningful contact should be our guiding light through all of these conversations and planning of parenting time,” he wrote. “Juno needs both of us. Ideally exactly equally.”

He also requested that Jodie talk to him about travel arrangements involving Juno before discussing it with their daughter to “save her confusion or disappointment.”

And while Jodie and Joshua have had their difficulties, as the Mighty Ducks alum noted, they share the goal of providing the best for their daughter. 

"It's my job," he said during an April episode of Jesse Tyler Ferguson's Dinner's on Me podcast, "shared with my ex-wife, to do everything that we can to nurture you, cultivate you and give you all the tools that you need in life."

He continued, "If I ever did anything to estrange my daughter from myself, I would be in duress. I actually can't conceive of it because I don't even wanna think of the pain that that would be."
